Executor or Executrix
A person or institution named in a will and appointed by a probate court to carry out the will's instructions and to manage the
probate
estate.
The term personal representative is a more general term that includes both an executor, named in a will, and an
administrator
, appointed by the court for persons that died
intestate
, or without a will.
Choosing Your Executor
Your executor should be the person whom you trust the most. The job of executor can be time consuming and involves a great deal of responsibility so you should make sure that person you choose is willing to do the job. You may also decide to appoint a company or bank to manage your estate for a fee. Your estate attorney can also help your executor through the process.
In the event your chosen executor is unable or unwilling to serve, you should appoint an alternate executor.
